AUSSOL PTY LTD – Standard Trading Terms & Conditions

1. General and Acceptance

  • These terms and conditions apply to all transactions between the Customer and Aussol Pty Ltd trading as TechieTools relating to the provision of goods and/or services.
  • These terms take precedence over any terms and conditions contained in any document of the Customer or elsewhere.
  • Placement of an Order signifies acceptance by the Customer of these terms and conditions and the most recent quote.

2. Quotes and Payment Structure

  • Any quote issued by the supplier will be valid for a period of fourteen (14) days from the date of issue.
  • Deposit: A non-refundable deposit of 20% of the total value quoted is required to initiate an order.
  • Balance: The remaining balance of the quote and any additional charges must be paid in full prior to the dispatch or delivery of the goods.
  • An indication in a quote of the time frame for the provision of goods is an estimate only and is not a fixed or binding time frame.

3. Warranty and Preventative Maintenance

  • Warranty Periods: Products carry either a 12-month or 24-month limited warranty as specified at the time of purchase.
  • Service Requirements: To maintain the validity of any 12 or 24-month warranty, machinery must be serviced by an authorized technician at the following intervals:
    • Every 6 months: For high-intensity use or high-value machinery.
    • Annually (12 months): For standard product lines as per manufacturer guidelines.
  • Warranty Voidance: Failure to perform required preventative maintenance or provide a verifiable service log upon request may result in the rejection of warranty claims for faults resulting from neglect or lack of upkeep.
  • Functionality: Small deviations or slight variations in color, durability, or specifications which do not substantially affect the Customer’s use do not entitle the Customer to reject the goods.

4. Default and Debt Recovery

  • Interest on all overdue amounts is charged at the rate of 10% per annum, calculated daily.
  • If an account is passed for collection, the Customer is liable for all reasonable expenses, including debt collection commissions and legal costs on a full indemnity basis.
  • TechieTools may withhold the provision of further goods or services until all overdue amounts are paid in full.

5. Shipping, Risk, and Retention of Title

  • Risk in Goods passes to the Customer immediately upon delivery or dispatch to the Customer’s carrier.
  • Ownership (Title) of Goods does not pass to the Customer until all moneys due to TechieTools have been fully paid.
  • The Customer grants an irrevocable license to TechieTools to enter the Customer’s premises to repossess goods if payment is not made within 14 days of supply.

6. Abandoned Equipment

  • Any equipment or peripherals not picked up within 14 days of a job completion notice will be considered abandoned and will become property of Aussol Pty Ltd.
  • TechieTools reserves the right to liquidate abandoned equipment to cover any outstanding balance or losses.

7. Limitation of Liability and ACL

  • Liability for breach of any guarantee under the Australian Consumer Law is limited to the replacement or repair of the Goods or the cost of resupplying the Services.
  • The Customer acknowledges that the Goods and/or Services are not for personal, domestic, or household purposes.
  • Within 48 hours of delivery, the Customer must notify TechieTools of any fault or discrepancy; otherwise, the goods are deemed accepted.
